The Secretary of the Army, through the Chief of Engineers, can declare a specific part of the Hackensack River in Hudson County not navigable and allow it to be filled and built on if engineering studies (to check bulkheads, filling, and the strength of permanent pile-supported structures) and environmental studies under the National Environmental Policy Act show the project is in the public interest. The area covered is a parcel of about 67.6 acres along the Hackensack River near the Erie Railroad and the Meadowlands Parkway. If approved, Congress agrees that any or all of that area may be filled and have permanent pile-supported structures built on it. That declaration only applies to parts of the parcel that are already bulkheaded and filled or that have permanent pile-supported structures. All plans for bulkheading, filling, and pile-supported structures must be approved by the Secretary of the Army through the Chief of Engineers. Local interests must repay the federal government for engineering and other costs the government incurs under this authority.
