§676 Allotment of Expenses for Common Dumping Grounds; Location of Impounding Works

Summary

When a joint petition is approved, the commission decides how much each mine owner must pay to provide and build needed dams or other restraining works. If a petition is filed later, or if the dams already exist and were accepted, the commission sets a reasonable fee for dumping. That fee is shared among the original dam owners in proportion to what each paid. The commission also divides the cost of keeping the joint dam or works maintained and protected among the mine owners who use it. Whenever possible, these dams must be built near or below the mines before the main tributaries.
