Title 33 › Chapter 14— CALIFORNIA DEBRIS COMMISSION › § 676
If a joint petition is granted, the commission must decide how much each mine owner pays to build needed dams or other holding works. If the petition comes after an order, or the works are already built and accepted, the commission sets a fair fee for dumping there and pays that fee to the original owners based on what each already paid. Costs to maintain and protect the shared dam or works must be split among the mine owners who use it in the shares the commission decides. When possible, these dams or works should be built and kept near or below the mines before the water reaches the main streams.
