Title 33 › Chapter 15— FLOOD CONTROL › § 701h–1
The Secretary of the Army can take money that a State or local government offers to speed up a federally approved water project and spend it right away on the work. If Congress later provides funds for repayment, the Secretary must pay back those amounts without interest. Money given to meet local cooperation conditions set by Congress or under section 701h cannot be repaid. For this rule, “State” includes the States, the District of Columbia, U.S. commonwealths, territories, possessions, and Indian tribes (as defined in section 5304(e) of title 25).
