Title 33 › CHAPTER 15 — FLOOD CONTROL › § 701r–1
Definitions: "Agency" means either the Corps of Engineers or the Bureau of Reclamation, whichever runs the project. "Head of the Agency concerned" means the Chief of Engineers or the Reclamation Commissioner (or their designee). "Water resources projects to be constructed in the future" means projects not yet built or parts of projects still unfinished. "Time of the taking" means the date of a relocation agreement, the date a condemnation case is filed, or another date the parties agree on. When building flood-control, navigation, irrigation, or other water projects, the Agency may use nearby public roads for access and may repair, rebuild, and keep up those roads. The Agency can work with the local government that owns the roads and may do the work with or without taking land if it decides that saves federal money. Before starting, the Agency must find it cheaper than building a new road. After construction ends, the Agency must, if needed, return the road to at least its prior condition and then stop being responsible for upkeep. If the government must replace a road it takes, the new road should serve as well as the old one. The Agency may build the replacement using the state’s normal design standards. If a state wants higher standards and pays the extra costs before work begins, the Agency can build to that higher standard. Federal spending for these roads is counted as part of the project’s nonreimbursable costs.
