Title 33 › CHAPTER 15 — FLOOD CONTROL › § 701–1
Require the Army Corps of Engineers to share information and work with the States when it studies or plans navigation or flood-control projects on rivers. The Corps must give affected States early notice of study results, offer chances to consult and to help with the studies, and send each State a copy of the proposed report. If the waters start west of the 97th meridian, the Corps must also give the Secretary of the Interior the same information and consultation chances. Affected States have 30 days to send written views and recommendations. The Secretary of the Army then sends the proposed report, with comments and the States’ and Interior’s views, to Congress. That transmittal and its attachments must be printed as a House or Senate document and made public. "Affected State or States": states where the project is located, states in the same drainage basin (including those west of the 98th meridian), and any east-of-98th-meridian states the Corps thinks will be significantly affected. Use of river water for navigation in states wholly or partly west of the 98th meridian must not conflict with beneficial consumptive uses (domestic, municipal, stock water, irrigation, mining, or industrial). The Secretary of the Interior must follow the same process for irrigation projects. If an affected State or the Secretary of the Army objects to an Interior irrigation plan, the project can only go forward if Congress approves it by law.
