The Corporation must negotiate with the Canadian Seaway authority (or another Canadian agency) about how to measure ships and cargo, what tolls to charge for using the Saint Lawrence Seaway, and how to split the seaway’s revenue. Any revenue-sharing plan that looks at annual debt costs must count the full U.S. financing cost, including both interest and debt principal, for projects under this law, even if the Corporation does not repay those costs. Measurement rules and tolls should, when possible, be made or changed only after public notice and a hearing. If talks fail, the Corporation may set the rules and tolls on its own, but it must give three months’ notice in the Federal Register and hold a public hearing during that time. New or changed rules take effect 30 days after the President approves them. Someone harmed by an order has 30 days after approval to ask the Corporation for a rehearing. The Corporation can change or keep its order. If the Corporation’s final action is approved by the President, it is final 30 days later unless an appeal is filed in the U.S. Court of Appeals for the region where the works are or in the D.C. Circuit. Those courts review the case the same way they review certain FERC appeals, and the Supreme Court may review by certiorari. Asking for rehearing or filing an appeal does not stop the order unless the Corporation or the court specifically orders a stay. When negotiating or setting tolls, the Corporation must follow these basic rules: make rates fair and encourage more use of the seaway; consider the special nature of bulk farm, mineral, and raw materials; vary rates by type of cargo so each class benefits; allow lower rates for ships in ballast (empty) without passengers; and set rates to cover, as closely as possible, operating and maintenance costs, including depreciation and payments made instead of taxes.
