To get a grant, the top leader of a State or local government must send an application to the Attorney General within 120 days after money for the year is approved. The application must say the federal money will add to, not replace, state or local funds. It must show the plan was sent to the governing body at least 30 days before filing, and that it was made public with a chance for citizens and community groups to comment. The applicant must promise to keep and report program and financial data the Attorney General asks for, and must sign a statement that the programs follow the rules, the application is accurate, agencies coordinated, and federal laws will be followed. The application must include a statewide plan for using the grants to improve the criminal justice system. That plan must be written with input from local governments and many criminal justice partners, explain how funds will be divided among the allowed uses, describe how evidence and data will guide decisions, list barriers to using data and proven approaches, and be updated every 5 years with yearly progress reports that note changing circumstances, funding adjustments, needs, past accomplishments, and how the plan affected funding. Not later than 90 days after December 16, 2016, the Attorney General must begin giving technical help to States and local governments to make and carry out the required plan, and may hire outside organizations to help. By the same date, the Attorney General must also start helping jurisdictions meet their Sixth Amendment duties by sharing model practices and helping adopt systems that follow the Sixth Amendment. For each fiscal year 2017 through 2021, between $5,000,000 and $10,000,000 of the program’s funds must be used for this technical help.
