§10406 Payment Requirements

Summary

The Attorney General must pay each eligible State or specially qualified local government the amount it was awarded. Payment must happen no later than whichever is later: 180 days after the money becomes available, or the first day of the payment period if the State has given the Attorney General the required assurances. If a State or unit does not spend all of its award, it must pay back the unspent money within 36 months of the award. The Attorney General may allow one one-time extension of up to 12 months. If money is not paid back, future payments to that State or unit will be reduced. Repayments go into a special fund for future payments. A State or local unit may use up to 5 percent of its award for administrative costs. The funds must not replace (supplant) State or local money; they must add to the money that would otherwise be provided. The Federal share of a grant can be no more than 90 percent of total program costs, except for building juvenile detention or correctional facilities, where the Federal share can be no more than 50 percent of the approved cost.
