The Attorney General must pay each State or specially qualified local government that applied the money it was awarded no later than the later of: 180 days after the money becomes available, or the first day of the payment period if the State has given the required assurances. Any award money that is not spent must be paid back to the Attorney General within 36 months of the award. The Attorney General can allow one one-time extension of up to 12 months. If money that must be repaid is not returned, future payments to that State or unit will be reduced. Repayments go into a special fund to pay future awards. A State or local unit may use up to 5 percent of its award for administrative costs. The money cannot replace State or local funding; it must add to what those governments would normally spend. The federal share of a grant may not be more than 90 percent of total program costs, except construction of juvenile detention or correctional facilities is limited to 50 percent of the approved cost.
