To get a grant, an applicant must send a written claim to the Attorney General saying three things. First, the lab’s DNA testing will meet or exceed the quality assurance standards for DNA analysis set by the FBI Director under section 12591. Second, DNA samples and test results will be shared only with criminal justice agencies for law enforcement ID, in court when allowed, with a defendant in the case for their defense, or, with personal identifiers removed, for population statistics, identification research, protocol development, or quality control. Third, the lab and every analyst must take semiannual external proficiency tests through a DNA testing program that meets the standards under section 12591.
