Each year, 85% of the money for this program must go to eligible States based on population. States that meet the rules in section 10562 get a share equal to their portion of the total population. Fifteen percent is for competitive grants the Attorney General can award to States and local governments. When picking winners, the Attorney General must consider each State’s average annual Part 1 violent crimes reported to the FBI for the three most recent calendar years and the applicant’s existing resources and needs. Every State must get at least 1% of the total. If there isn’t enough money to give every State 1%, the Attorney General must reduce the 85% population-based shares to cover the shortfall, cutting them in the same proportions they would have had. The word “State” means the 50 States, the District of Columbia, Puerto Rico, the Virgin Islands, American Samoa, Guam, and the Commonwealth of the Northern Mariana Islands. For the allocation rules, American Samoa and the Northern Mariana Islands count as one State, with 67% of that combined share going to American Samoa and 33% to the Northern Mariana Islands.
