Circuit judicial councils are encouraged to carry out studies to find if gender bias exists in the federal courts and to put recommended fixes into practice. The reviews can look at many things, including how litigants, witnesses, lawyers, jurors, and judges (including magistrate and bankruptcy judges) are treated; how civil and criminal law is applied; treatment of defendants and victims of violent crime; sentencing and supervision; appointments to committees and to roles like arbitrators or experts; case management and dispute-resolution programs; hiring, promotion, and workplace treatment; and rules about a victim’s past sexual history, plus related topics in section 12372. The Administrative Office of the U.S. Courts will collect and share the task force reports and respond to requests for them. The Federal Judicial Center must include these topics in its judge training, including for newly appointed judges, and prepare the needed training materials.
