Men who father children by rape should be barred from visiting or having custody of those children. Thousands of rape-related pregnancies happen in the U.S. every year. Many survivors raise those children and can end up in custody fights with their rapists. Rape is very under‑prosecuted, with criminal convictions in less than 5 percent of cases. Most states use the "clear and convincing evidence" standard to end parental rights, and the Supreme Court said that standard meets due process in Santosky v. Kramer (455 U.S. 745 (1982)). Only 10 States now let survivors ask to end a rapist’s parental rights using that standard. Forcing survivors to deal with a rapist for custody can cause trauma, hurt their recovery, harm their ability to raise a healthy child, and be used to threaten or manipulate them.
