Samples or test results taken under sections 40701, 40702, or 40703 may be used only for the specific purposes those sections allow. They can be shared only when the rules for the Combined DNA Index System (CODIS) permit it, as listed in section 12592(b)(3)(A)–(D). Anyone who knowingly shares, obtains, or uses such a sample or result without authorization can be fined up to $250,000 or jailed for up to one year. Each time it happens is a separate offense.
