States must collect DNA from adults (age 18 or older) who are arrested or charged for certain serious crimes and put those DNA profiles into the National DNA Index System. The rule covers five types of crimes: homicide; sexual crimes that involve a sexual act or sexual contact and are punishable by more than 1 year in prison; kidnapping or abduction punishable by more than 1 year; burglary punishable by more than 1 year; and aggravated assault punishable by more than 1 year. DNA arrestee collection process: a State’s system for collecting those DNA profiles for the National DNA Index System. State: any U.S. State, the District of Columbia, Puerto Rico, the Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands.
