Title 34 › Subtitle IV — Criminal Records and Information › CHAPTER 413 — CRIME REPORTS AND STATISTICS › § 41305
The Attorney General must collect yearly data on crimes that show bias because of race, gender (including gender identity), religion, disability, sexual orientation, or ethnicity. This covers murder, non‑negligent manslaughter, rape, aggravated assault, intimidation, arson, and property damage or vandalism. They must set rules for collecting data and defining what counts as bias, and publish an annual summary including crimes by and against juveniles. The data may only be used for research or statistics and may not identify victims. The law does not create a new right to sue, including claims about sexual orientation; "sexual orientation" means consensual homosexuality or heterosexuality. It does not remove existing rights to sue, including under the Administrative Procedure Act or All Writs Act. Funds may be provided as needed through fiscal year 2002.
