Each agency head must create rules no later than one year after August 3, 2022 to make sure a designated person can ask for a review and that the agency follows the chapter’s requirements. The rules must name an internal office to get and investigate complaints about reviews under section 60901 or reinvestigations under section 60903, require staff training on these procedures, include discipline (including suspension or firing) for willful or reckless noncompliance, set up a way to resolve complaints about cold case murder investigations or file evaluations, and say the agency head or their designee is the final decision-maker with no court review by the complainant.
