States, state agencies, and state officials cannot use the Eleventh Amendment or any other sovereign immunity rule to avoid being sued in federal court by any person or organization for patent infringement under section 271 or for other violations under this title. In those lawsuits, the same remedies that apply against private parties are available, including damages, interest, costs, treble damages under section 284, attorney fees under section 285, and the extra remedy for design patents under section 289.
