When the Director finds a substantial new question about a patent claim after review, the Director must order a reexamination to answer that question. The patent owner gets a fair time, at least two months from when the decision is sent, to file a statement. The owner’s statement can include changes to the patent and new claims. If the owner files, they must quickly send a copy to the person who asked for reexamination. That person then has two months from getting the owner’s statement to file a reply and must promptly give the reply to the patent owner.
