To be considered, a petition must follow five rules. The filer must pay the fee set by the Director, name everyone who has a stake in the petition, identify each patent claim being challenged and explain the reasons with supporting proof (like copies of patents or publications and any sworn statements or expert opinions), give any other information the Director’s rules require, and send copies of these documents to the patent owner or their chosen representative. After the Director receives a petition, the Director must make it available to the public as soon as possible.
