Title 37 › Chapter 3— BASIC PAY › § 212
If a service member is sent to a place where special pay is available and the orders are for one year or more (or the tour is extended past one year), the member can ask while on that tour for up to three months of basic pay paid in advance. A request for one month must be approved. Requests for the second or third month can be approved only if the member shows financial hardship. The advance must be repaid in equal installments over one year, starting the first day of the first month on or after the advance is given. If the member is on active duty in a repayment month, that month’s installment is taken from basic pay. If the member dies before finishing repayment, the estate does not have to pay the rest.
