Title 37 › Chapter 5— SPECIAL AND INCENTIVE PAYS › Subchapter I— EXISTING SPECIAL PAY, INCENTIVE PAY, AND BONUS AUTHORITIES › § 321
An active-duty judge advocate who has finished the required time from their original commission (or the required time for a special detail) can sign a written agreement to stay on active duty and get continuation pay. An eligible judge advocate is an active-duty officer who is qualified as a judge advocate and who has completed the required service. The Secretary must accept the agreement for pay to be made. Total pay under one or more agreements cannot be more than $60,000. The time and pay can be prorated. The Secretary will fix the total amount and set a payment schedule. The pay is extra to other pay. If an officer leaves before finishing the agreed time, they must repay as required by section 303a(e). The Secretary must write rules to run this program.
