Title 37 › CHAPTER 5 — SPECIAL AND INCENTIVE PAYS › SUBCHAPTER III — GENERAL PROVISIONS › § 373
If a service member gets a bonus, special pay, or similar benefit that depends on meeting certain service or eligibility rules, the member must pay back any part they did not earn if they fail to meet those rules. The member also cannot get any unpaid portion of that benefit after they stop meeting the requirements. The Secretary in charge can make exceptions under rules they write if forcing repayment or stopping payment would conflict with personnel policy, be unfair, or not be in the best interest of the United States. If the member dies or leaves service with a combat-related disability, they or their estate do not have to repay unearned amounts, and any unpaid remainder the member was entitled to must be paid in full to the member or their estate in a single payment no later than 90 days after death or separation, unless the death or disability was caused by the member’s misconduct. A member who gets a sole survivorship discharge also does not have to repay previously paid unearned amounts, and the Secretary may allow continued payments of unpaid amounts for the same fairness or policy reasons. Any required repayment is a debt to the United States and is not wiped out by bankruptcy if the bankruptcy discharge is entered less than five years after the end of the agreement or, if there was no agreement, the end of the service obligation. Definitions: “bonus, incentive pay, or similar benefit” means bonuses, special pay, or educational stipends covered by this repayment rule. “Service” here means the service obligation a member agreed to in exchange for the benefit, such as staying on active duty, serving in a particular job, location, or for a set time.
