Title 38 › Part II— GENERAL BENEFITS › Chapter 17— HOSPITAL, NURSING HOME, DOMICILIARY, AND MEDICAL CARE › Subchapter III— MISCELLANEOUS PROVISIONS RELATING TO HOSPITAL AND NURSING HOME CARE AND MEDICAL TREATMENT OF VETERANS › § 1722C
The VA Secretary cannot charge or collect copayments for a veteran’s first three outpatient mental health visits in a calendar year when those visits would otherwise require a copay under VA rules. This rule does not stop copays for medications under section 1722A. A "mental health care outpatient visit" means an outpatient visit with a qualified mental health professional mainly to get mental health care or treatment for substance abuse. This rule ends five years after the date the Joseph Maxwell Cleland and Robert Joseph Dole Memorial Veterans Benefits and Health Care Improvement Act of 2022 was enacted.
