The Secretary can transfer inactive cemeteries, burial plots, memorials, or monuments under the Secretary’s control to the Department of the Interior (or to another federal agency) if that agency agrees. Cemeteries given to the Interior become part of the National Park System, and Park System funds may be used to manage them. The Secretary can also give full ownership to a State, county, city, or their agency. If that new owner stops caring for the site in a way the Secretary approves, ownership goes back to the United States. The Secretary may move remains from closed, abandoned, or temporary burial places into a national cemetery, including veterans’ remains.
