The Secretary of the Army must set aside part of Arlington National Cemetery for burying cremated remains without grave markers. That area must be one that cannot be used for casket burials, and the Army will create rules for how it is used. Each military department must give service members a form to say they want burial there. People whose service was found to be active duty under the GI Bill Improvement Act of 1977 (Public Law 95–202; 38 U.S.C. 106 note) may have their ashes placed above ground with military honors under section 1491 of title 10.
