Allows certain people who left active military service with an honorable discharge and who got voluntary separation pay under 10 U.S.C. 1174a or 1175 to choose basic education benefits under this chapter, but only if money is available. To qualify they must have a high school diploma (or equivalent) or at least 12 semester hours of college credit. They must withdraw any earlier election under 3011(c)(1) or 3012(d)(1) before leaving, following procedures the military departments or the Secretary of Homeland Security (for the Coast Guard) set. People already in the chapter 32 program can make a one-time, final switch to these benefits before leaving. Nearly the same option is available to people who left before October 23, 1992, but they must make the choice by October 23, 1993, and the Secretary acts after consulting the Secretary of Defense. If the choice is made while still serving, basic pay or separation pay will be reduced by $1,200. For those who already left before October 23, 1992, $1,200 will be collected and sent to the U.S. Treasury. Any withdrawal to change an earlier election is final. If someone leaves chapter 32 to take these benefits, they will be removed from chapter 32 and get refunds of unused contributions, while certain Defense Department contributions will remain to pay specified benefits.
