§3605 Payment of Educational Assistance in Cases of Withdrawal

Summary

The Secretary must find mitigating circumstances under section 3680(a)(1)(C)(ii) when an individual withdraws from an in-person (not correspondence) education or training program at an institution under chapters 31, 34, or 35 because of a covered reason during an emergency. A "covered reason" means any emergency-related cause, including seven types: illness, quarantine, or social distancing; accessibility problems; childcare access or availability; caring for a family member or household member; moving because of the emergency or school closures; job changes or financial hardship; and changes in the course format or how instruction is delivered.
