Each State’s chief executive is asked to create or pick a State department or agency to serve as the “State approving agency” for the education benefit programs covered by this law and chapters 34 and 35. If a State does not pick one or does not sign the required agreement under section 3674(a), the term “State approving agency” will instead mean the Secretary for that State. Also, for courses the Secretary must approve under section 3672, references to the State approving agency mean the Secretary. The Secretary may not accept a department as the State approving agency if it is run at, or located with, a university or university system that offers programs the agency would approve.
