Title 38 › Part III— READJUSTMENT AND RELATED BENEFITS › Chapter 36— ADMINISTRATION OF EDUCATIONAL BENEFITS › Subchapter III— MISCELLANEOUS PROVISIONS › § 3691A
If a service member gets orders to start covered military service, they may withdraw or take a leave from school paid with covered education benefits. The school must not punish the student for leaving. That means no failing grade, no drop in GPA, no marking the absence unexcused, and no financial penalty. If the student withdraws, the school must refund all tuition and fees for that term, including housing payments. If the student takes a leave, the school must give an “incomplete” (or similar) for that term and, when possible, let the student finish the term after the service ends. Covered education: higher‑education courses paid with educational benefits under a law run by the Secretary. Covered member: a member of the Armed Forces (including reserves) enrolled in covered education. Covered service: active service, inactive‑duty training, or State active duty. Institution concerned: the school where the student is enrolled. Institution of higher education: the meaning in the Higher Education Act of 1965 (20 U.S.C. 1001). Period of covered service: from entering covered service until release or death while in service.
