Summary

If the Secretary, the Attorney General, or the Special Counsel cannot meet a deadline under section 4322, 4323, or 4324, that missed deadline does not stop the Attorney General or Special Counsel from filing cases or complaints under 4323 or 4324. It also does not take away a person’s right to start a case or file a complaint under those sections, to get help or relief allowed by this chapter, or to have a Federal court, the Merit Systems Protection Board, or a State court hear the case. An employer or the Office of Personnel Management cannot use the missed deadline as a defense, including saying someone waited too long. If one of those officials can’t meet the specific deadlines in 4322(f), 4323(a)(1), 4323(a)(2), 4324(a)(1), or 4324(a)(2)(B) and the person agrees to extra time, the official must finish the action within the added time. There is no time limit for filing a complaint or claim under this chapter with the Secretary, the Merit Systems Protection Board, or a Federal or State court.
