When a person entitled to certain VA periodic payments dies, any unpaid periodic monetary benefits (called “accrued benefits”) must be paid to survivors in a set order. This does not include insurance or servicemen’s indemnity and is subject to sections 3329 and 3330 of title 31. If someone was getting an apportioned share of a veteran’s benefits, the unpaid amounts can be paid to the veteran or to other dependents as the Secretary decides. If the veteran died, unpaid benefits go first to a living spouse, then to children (split equally), then to dependent parents (split equally). If a surviving spouse dies, payments go to the veteran’s children. If a child who was receiving benefits dies, payments go to the veteran’s surviving children or parents in certain cases. If none of these apply, benefits may be paid only to reimburse the person who paid the last sickness and burial costs. No part of accrued benefits may be used to repay any political subdivision of the United States for those expenses. Claims for accrued benefits must be filed within one year after the date of death. If an application is incomplete, the Secretary will tell the claimant what proof is needed. If the needed proof is not given within one year of that notice, the accrued benefits cannot be paid.
