If a noncitizen who gets free benefits from the Secretary goes to land or areas controlled by an enemy of the United States or its allies, their benefit payments must stop right away. They can get benefits again only after they file a new claim and give proof acceptable to the Secretary that they did not commit mutiny, treason, sabotage, or help the enemy. No payments will be made for any time before the new claim is filed, except as provided in section 5309. While the person is in enemy territory, the Secretary may choose to pay some of the benefits to the person’s dependents. No dependent can get more than the amount they would receive if the beneficiary were dead.
