The Secretary must let the Department’s lawyers sue in any court that can hear the case to get back debts people owe the United States because they took part in benefit programs the Secretary runs. A lawsuit can only start after the Secretary, under rules the Secretary makes, finds the person did not properly respond to reasonable administrative attempts to collect the debt. Those lawyers must work under the Attorney General’s direction and follow any conditions the Attorney General sets. This does not reduce the Attorney General’s power under sections 516 and 519 of title 28 to direct and supervise all litigation involving the United States or its agencies or officers.
