Title 38 › Part IV— GENERAL ADMINISTRATIVE PROVISIONS › Chapter 53— SPECIAL PROVISIONS RELATING TO BENEFITS › § 5317A
The Secretary may stop, deny, suspend, or cut certain benefits or services for people under 65 who apply for or get them based on income information from the Department of Health and Human Services under the Social Security Act, but only after independently checking the person’s job and wages. The Secretary must tell the person the verified findings and give them a chance to challenge those findings the same way they can challenge other eligibility decisions. The Secretary must pay HHS’s cost for providing the information from funds available for compensation and pensions. This authority applied from December 26, 2007, to November 18, 2011, and again from the day the Department of Veterans Affairs Expiring Authorities Act of 2013 became law until 180 days later.
