Title 38 › PART V — BOARDS, ADMINISTRATIONS, AND SERVICES › CHAPTER 73 — VETERANS HEALTH ADMINISTRATION—ORGANIZATION AND FUNCTIONS › SUBCHAPTER III — PROTECTION OF PATIENT RIGHTS › § 7334
The Secretary must, as much as possible while following the rest of the law, make certain Health and Human Services rules apply to VA research and to hospital, nursing home, domiciliary, and other medical care provided under this title. Those rules include HHS rules on human experiments and informed consent based on the National Commission (created by the National Research Act (Public Law 93–348; 88 Stat. 348)), and HHS rules about confidentiality of drug and alcohol treatment records and admission of drug or alcohol abusers to hospitals under the Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment, and Rehabilitation Act of 1970 (42 U.S.C. 4551 et seq.) and the Drug Abuse Office and Treatment Act of 1972 (21 U.S.C. 1101 et seq.). The Secretary may add definitions, safeguards, and procedures — including rules about court orders under section 7332(b)(2)(C) — to prevent people from evading the rules or to help follow them. The Secretary must consult with the Secretary of Health and Human Services and, when appropriate, the President (or the President’s delegate) from time to time to coordinate the rules and how they are put into practice.
