The Secretary may let the Under Secretary for Health pay advance payments, hiring or relocation bonuses, retention pay, and interview costs to certain VA health staff hired under specific appointment rules. These payments must follow rules like those in 5 U.S.C. 5524a, 5706b, 5753, and 5754. Money paid this way does not count when figuring the limit in section 7431(e)(4) of this title. The Secretary may also allow the Under Secretary for Health to give a VA pharmacist executive up to $40,000 a year as extra incentive pay to recruit and keep them. When deciding the amount, the Under Secretary must look at grade and step, job scope and complexity, the person’s qualifications, the local labor market, and any other appropriate factors. This extra pay is added to other pay and allowances. Except where noted, it is treated as basic pay for purposes like retirement under chapters 83 and 84 of title 5, but it is not basic pay for adverse actions under subchapter V of this chapter. The extra pay cannot make a person’s total yearly pay (including bonuses and awards) exceed the annual pay of the President.
