Title 38 › Part V— BOARDS, ADMINISTRATIONS, AND SERVICES › Chapter 74— VETERANS HEALTH ADMINISTRATION—PERSONNEL › Subchapter II— COLLECTIVE BARGAINING AND PERSONNEL ADMINISTRATION › § 7426
People appointed to the Administration must be covered by the regular federal retirement systems in title 5 (either chapter 83 or chapter 84), whichever applies. If a person retires after December 31, 1981 (except if they retire under sections 8337 or 8451), and they ever worked part-time in an Administration job to which they were appointed, their pension is figured this way: for average pay, use their full‑time pay rate; compute the pension as if they were full‑time, then multiply that amount by the fraction equal to their full‑time equivalent service divided by their total creditable service. Full‑time equivalent service means creditable service with any part‑time periods reduced proportionally; full time counts as 80 hours in a two‑week pay period. A survivor annuity is worked out from that adjusted pension. Part‑time work before April 7, 1986 by a registered nurse, physician assistant, or expanded‑function dental auxiliary is treated as full time for these calculations.
