Disciplinary Appeals Boards must handle reviews when a serious penalty is taken against a certain VA employee for questions about professional conduct or competence. If a case mixes those kinds of charges with other kinds, the board must say it has exclusive power over the professional-conduct portion and explain why. Before any major penalty, the employee must get written notice that explains each charge, the possible penalties, the specific rule said to be broken, and the file of evidence (unless notice is waived because a criminal act is suspected). The employee has 7 business days to answer in writing and orally to a higher-level official and may submit documents and affidavits. The employee may have a lawyer or other representative at every step. The deciding official must give a written decision with reasons within 15 business days after the notice. Appeals to the board must be filed within 7 business days of that decision. The board first checks it has the right to hear the case. It can sustain, dismiss, or partly sustain charges, and can approve, change, or reverse the action. The board must offer an oral hearing and give a transcript. The board must decide within 45 days after a hearing, or no later than 120 days after the appeal started. The Secretary must carry out the board’s decision within 90 days, and may order reinstatement, back pay, or record changes. The Secretary can reverse, send back, or reduce board actions in limited situations. The Secretary’s action is the final administrative step. An employee may go to court to review the decision, and the court can overturn agency action that is arbitrary, unlawful, procedurally flawed, or lacks substantial evidence.
