The Secretary can make agreements with the institutions named in section 8153(a) to buy medical equipment together. The Secretary cannot pay more than one-half of the purchase price. The Secretary must buy the equipment, and ownership will be shared by the United States and the institution. Before the equipment is used, the parties must have a contract under section 8153 that sets out how it will be shared or used. The Secretary cannot place the purchase order until the institution gives its share of the price. The Secretary may give the Department’s share of jointly owned equipment to the institution if there are strong clinical or economic reasons, but only if the institution agrees to pay one-half of the depreciated purchase price; that payment goes to the Department’s medical funds. The Secretary may also buy the institution’s share for the same types of reasons, but may not pay more than one-half of the depreciated purchase price.
