The Secretary may transfer full U.S. ownership of leased VA property to the lessee if, during the lease or within 30 days after it ends, the Secretary finds the Department no longer needs the property. The Secretary must also decide that using this transfer is better for the Department than using sections 8118 or 8122. The transfer can be for cash at fair value and any other terms the Secretary chooses. At least 45 days before the transfer, the Secretary must tell the congressional veterans’ affairs committees and publish a Federal Register notice that explains the background, reasons, economic factors (including a cost–benefit summary), and the planned method, terms, and conditions.
