Title 39 › Part II— PERSONNEL › Chapter 12— EMPLOYEE-MANAGEMENT AGREEMENTS › § 1208
Gives U.S. courts the same power to hear cases brought by the National Labor Relations Board under this law as they have for cases under title 29. Contract disputes between the Postal Service and a postal labor union, or between unions, can be filed in any U.S. district court that has the parties, no matter how much money is at issue. A labor union and the Postal Service are bound by what their agents do for them. A union can sue and be sued as one group and can act for its members. Money judgments against a union can only be collected from the union itself and its assets, not from individual members. A U.S. district court has power over a union where the union’s main office is or where its officers or agents represent members. Giving legal papers to an officer or agent while acting for the union counts as giving them to the union.
