The President may, using the head of an executive department and on terms that head thinks best, sell to private people, other federal departments, or foreign governments fighting an enemy of the United States: war supplies, materials, and equipment; the by‑products of those items; and any building, plant, or factory (and the land) bought since April 6, 1917 for making such supplies that the government owned during the emergency on July 9, 1918. Laws that allow sale of guns and ammunition limit buyers to other government departments, foreign governments fighting a country the United States is at war with, and members of the National Rifle Association or similar U.S. groups that promote small‑arms target practice.
