A State or local government can get these benefits only if it keeps its own spending for the Appalachian part of the State at or above the average level of the State’s two full fiscal years before March 9, 1965. When figuring that average, do not include state money spent for participation in the Dwight D. Eisenhower System of Interstate and Defense Highways or any local or federal funds. The Commission may tell the President to allow a lower spending requirement if the Appalachian part of the State has had a large loss of people so the old spending level is not reasonable, or if past spending in a specific program was higher than the current need.
