Title 40 › Subtitle SUBTITLE IV— APPALACHIAN REGIONAL DEVELOPMENT › Chapter 145— SPECIAL APPALACHIAN PROGRAMS › Subchapter II— ADMINISTRATIVE › § 14523
A program or project created under this chapter cannot begin until two things happen. First, the federal official in charge must decide the applications and plans do not conflict with federal laws that the official enforces, so long as those laws do not conflict with this subtitle. Second, the Appalachian Regional Commission must approve the program or project, find it meets the rules in sections 14524 and 14525, and determine it will help develop the Appalachian region. The Appalachian Regional Commission’s approval controls, and federal agencies must accept it.
