A transfer under this chapter must only happen if the Secretary of Defense finds all of the following are true: the federal government does not need to keep the property for national defense; the transfer is in the public interest; the person getting the property is ready and qualified to keep the communications service running without interruption; and the long‑line communications facilities will not be owned, run, or controlled, directly or indirectly, by anyone who would be disqualified from holding a radio station license under section 310(a) of the Communications Act of 1934 (47 U.S.C. 310(a)).
