Summary

Each executive agency must, during the calendar quarter after a fiscal year ends, send a report to the Administrator of General Services and to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives. The report covers personal property obtained as excess or found to be no longer needed for the purpose of the appropriation used to buy it, when given within the United States to someone who is not a federal agency. It must list equipment categories, acquisition cost, the recipient, and any other details the Administrator asks for. Within 180 days after the fiscal year ends, the Administrator must compile those reports, send the compiled report to the same two committees, and publish a public report on a centralized website. The public report must show the full data in a user-friendly way, include a summary with the total dollar value of property judged no longer required for the purpose of the appropriation used to make the purchase, and list any recommendations from the Administrator.

(a)During the calendar quarter following the close of each fiscal year, each executive agency shall submit to the Administrator of General Services and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report on personal property—

(1)obtained as—

(A)excess property; or

(B)personal property determined to be no longer required for the purpose of the appropriation used to make the purchase; and

(2)furnished within the United States to a recipient other than a federal agency.

(b)The report must set out the categories of equipment and show—

(1)the acquisition cost of the property;

(2)the recipient of the property; and

(3)other information the Administrator may require.

(c)Not later than 180 days following the close of a fiscal year, the Administrator shall compile the data in the reports submitted under subsection (a) and submit to the Committee on Homeland Security 11 So in original. The word “and” probably should appear. Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives and publish on a centralized online website a publicly available report, which shall include—

(1)the complete data provided in each report in a user-friendly format;

(2)a summary of the findings of each report, including the aggregate dollar amount of personal property determined to be no longer required for the purpose of the appropriation used to make the purchase; and

(3)any other recommendations from the Administrator.

Amendment of Section Pub. L. 118–99, § 2(e)(1), Oct. 1, 2024, 138 Stat. 1579, provided that, effective on the date that is 5 years after Oct. 1, 2024, this section is amended: (1) in subsection (a), in the matter preceding paragraph (1), by striking “and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives”; and (2) by striking subsection (c).
