Maritime Administration must sell or otherwise transfer surplus ships of 1,500 gross tons or more if they are merchant ships or can be made into merchant ships. Those sales must follow the rules in title 46, part F, and any other laws that allow selling such vessels. The NOAA Administrator may instead sell or transfer NOAA’s covered vessels and equipment (survey and research ships and their gear). For the 2-year period beginning on the date of enactment of the National Defense Authorization Act for Fiscal Year 2026, NOAA may keep the money from those sales and use it, without fiscal year limits, to buy new covered vessels or equipment or to repair and maintain existing ones, even if section 571 of this title or section 3302 of title 31 would otherwise apply.
