Federal agencies must not use federal money to buy electricity in a way that breaks state rules about electric utility service. They must follow state utility commission orders and respect utility franchises or service areas set by state law, state rules, or state-approved territorial agreements. Agency heads may still enter contracts under section 801 of the National Energy Conservation Policy Act (42 U.S.C. 8287). Secretaries of military departments may enter contracts under section 2394 of title 10, and may buy power from a different provider if the franchised utility cannot meet special reliability needs needed for national defense.
