The Secretary of the Interior, after talking with the National Capital Memorial Commission, can pick a temporary site on Interior-managed land in Washington, D.C., if such a site is needed to help protect the limited open space for people in the capital. At least 120 days before naming the site, the Secretary and the Commission must send Congress a plan that covers the location, construction, running of the site, and rules for displays. Any person who puts up a commemorative display must pay all costs, take all risks, and agree to cover any legal claims or damages to the United States.
