Agencies must not pay people who are not federal personnel to do evaluations or analyses of any part of a proposal for a contract unless trained and capable federal people are not readily available. The rule covers three kinds of federal personnel: federal employees (see 5 U.S.C. 2105), members of the armed forces, and individuals assigned to an agency under subchapter VI of chapter 33 of title 5. The head of each executive agency must decide, using the standards and procedures in the Federal Acquisition Regulation, whether enough of those federal people are available and have the needed training. This does not change the relationship with a federally funded research and development center.
